DMCA Copyright Policy
Last updated: October 17, 2026
Arct Technology LLC ("Arct Cloud", "we", "us") responds to notices of claimed copyright infringement under the US Digital Millennium Copyright Act (17 U.S.C. 512) (the "DMCA"). This DMCA Copyright Policy ("Policy") applies to every Server on our network and to the Platform, wherever the customer or the Server is located. It applies alongside our Terms of Service (the "Terms") and our Acceptable Use Policy (the "AUP"). Capitalised terms that this Policy does not define, such as "Account", "Customer Content", "End User", "Platform" and "Server", have the meanings given in the Terms.
We expect our customers to respect the intellectual property rights of others. In appropriate circumstances and in our discretion, we may remove or disable access to material claimed to infringe, suspend access to the Services, and terminate the Accounts of customers who infringe. For customers, this Policy forms part of the AUP and therefore of the Agreement described in the Terms.
Send a notice through the copyright category on our Report abuse page, or to our designated agent in section 2. Notices sent another way can take longer to reach the right team.
1. How to report copyright infringement
Only the copyright owner, or a person authorised to act for the owner, may send a notice. Your notice must be in writing and include the elements that 17 U.S.C. 512(c)(3) requires:
- the physical or electronic signature of the copyright owner or of a person authorised to act for the owner;
- identification of the copyrighted work that you say is infringed. If one notice covers several works at one site, a representative list of them is enough;
- identification of the material that you say infringes and that you want removed or disabled, with enough detail for us to find it: the full URL, or, where there is no URL, the IP address with the port, the protocol and the date and time;
- information reasonably sufficient for us to contact you, such as your name and email address and, if available, your postal address and telephone number;
- a statement that you believe in good faith that the use of the material in the way you describe is not permitted by the law or by the copyright owner or its agent; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of the exclusive right that you say is infringed or are authorised to act for the owner.
We accept a typed full name as an electronic signature. If a notice is incomplete, we may contact you to ask for the missing details. We are not required to act on a notice that does not substantially comply with this section.
Before you send a notice, consider whether the use could be lawful, for example as fair use. Section 7 explains the consequences of a knowing misrepresentation.
This Policy covers copyright only. Send trademark complaints and other reports through our Report abuse page.
2. Designated agent
Our designated agent receives copyright notices and counter-notices:
- Name: DMCA Agent, Arct Technology LLC
- Postal address: 30 N Gould St Ste R, Sheridan, WY 82801, United States
- Email: [email protected]
The designated agent accepts only notices and counter-notices under this Policy. Other messages sent to the designated agent may not receive a response.
3. What happens next
When we receive a notice that substantially complies with section 1, we:
- confirm receipt to you;
- forward the notice in full, including your name and contact details, to the customer whose Server is involved; and
- require the customer to remove or disable access to the material by the deadline in our notice.
If the customer removes or disables the material, we treat the notice as resolved. If the customer does not act by the deadline, we may disable access to the material by disabling the Server or the IP address involved. We cannot remove individual files from a customer's Server.
We may also, in our discretion, remove or disable access to the material, or disable the Server or IP address involved, at any time and without prior notice to the customer, including before the deadline in our notice. We may do so, for example, where the customer cannot be reached, the same material was the subject of an earlier notice, or the law or a court order requires it. When we remove or disable access to material, we take reasonable steps to notify the customer promptly.
We may decline to act on a notice that does not substantially comply with section 1, or that we reasonably believe is fraudulent, abusive or sent for an improper purpose.
We may share notices and counter-notices, including the personal information in them, with the customer concerned, who may pass them to the End User responsible, and with competent authorities where the law requires. We may also send copies of notices, with the sender's personal contact details removed, to third parties such as the Lumen database (lumendatabase.org), which may publish them. By sending a notice or counter-notice, you agree that we may share it as this section describes.
4. If you receive a copyright notice
If we forward a copyright notice to you, you must remove or disable access to the material within the period stated in our notice, which we set in our discretion, and tell us that you have done so. If you believe the material was removed or disabled because of a mistake or misidentification, you may then send a counter-notice under section 5.
While a counter-notice is pending, the material must stay down. You must not restore, re-upload or move the material to another location on the Services, except as section 5 allows. If we disabled your Server or IP address, we restore it once you have removed or disabled the material and told us, unless we have other grounds to act under the Terms or the AUP. If you host services for others, you must pass the notice to the End User responsible and make sure it is handled by the deadline.
You may use the sender's contact details only to respond to the notice or to pursue your legal rights in relation to it. You are responsible for Customer Content and for any claim that it infringes. Section 16 of the Terms applies to such claims.
5. Counter-notices
A counter-notice must be in writing, sent to our designated agent (section 2), and include the elements that 17 U.S.C. 512(g)(3) requires:
- your physical or electronic signature;
- identification of the material that was removed or disabled, and the URL or IP address where it appeared before;
- a statement under penalty of perjury that you believe in good faith that the material was removed or disabled as a result of a mistake or misidentification of the material;
- your name, address and telephone number; and
- a statement that you consent to the jurisdiction of the US federal district court for the judicial district where your address is located or, if your address is outside the United States, of any judicial district in which Arct Cloud may be found, and that you will accept service of process from the person who sent the original notice or that person's agent.
We may decline to process a counter-notice that does not substantially comply with this section.
When we receive a complete counter-notice, we promptly send a copy of it, including your name, address and telephone number, to the person who sent the original notice. We tell that person that we will restore the material, or stop disabling access to it, in 10 business days.
We then restore the material, or tell you that you may restore it, no sooner than 10 and no later than 14 business days after our designated agent receives the counter-notice. We do not restore it if, before then, our designated agent receives notice that the person who sent the original notice has filed an action seeking a court order to restrain you from the infringing activity relating to the material on our network.
Restoring material is not a finding that it does not infringe. This section does not limit our right to act under the Terms or the AUP for reasons other than the notice.
6. Repeat infringers
We keep a record of the copyright notices made against each Account. A notice counts against an Account when it was complete and valid, unless it was withdrawn, a counter-notice led to the material being restored, or a court found the use lawful.
In appropriate circumstances, we terminate the Accounts of customers who are repeat infringers. In deciding, we consider the number of notices that count against the Account, the period in which they arrived, how the customer responded to them and any other circumstances we consider relevant. We do not offer refunds after termination.
We may also, in our discretion, limit, suspend or terminate the Services of any customer that we reasonably believe infringes the intellectual property rights of others, whether or not the customer is a repeat infringer. A customer whose Account we terminate under this section may not open a new Account without our written consent.
7. Misrepresentation
Under 17 U.S.C. 512(f), a person who knowingly and materially misrepresents in a notice that material is infringing, or in a counter-notice that material was removed or disabled by mistake or misidentification, may be liable for the damages that result, including costs and attorneys' fees. Those damages can include the losses of the alleged infringer, of the copyright owner or its licensee, and of Arct Cloud as the service provider. We may report abuse of the notice or counter-notice process to the competent authorities and pursue the remedies available to us.
8. Common questions
The material is still online after the customer acted
It may be cached in your browser or by another service, or it may have moved to a server outside our network. We can act only on material on our network. If it moved to another Arct Cloud Server, send a new notice that names the new URL or IP address. If you view the material through a VPN, proxy or similar tool, or it is available only in some countries, tell us which tool and location you use, because we may not be able to see it from ours.
Our role
We do not monitor what customers store on their Servers, and we do not decide whether material infringes copyright. That question is for the copyright owner, the customer and, if they disagree, a court.
Content behind a CDN or proxy
A content delivery network or proxy can hide the server that holds the material. Ask that provider for the origin IP address and include it in your notice, so we can find the Server. Where we need that information from the provider ourselves, handling your notice can take longer.
Customers outside the United States
Arct Cloud and its customers must follow US law. If you are an Arct Cloud customer and do not act on a DMCA notice, we may disable the Server that hosts the material to comply with applicable law.
Legal advice
This Policy is general information and not legal advice. If you are unsure whether material infringes, or whether to send a notice or counter-notice, consult a lawyer.
9. Our role and liability
We have no obligation to monitor Customer Content for infringement. We are not obliged to investigate, mediate or decide the merits of any notice, counter-notice or dispute between a copyright owner and a customer. An action we take under this Policy is not an admission or a finding that material infringes or does not infringe.
Our rights under this Policy are in addition to our rights under the Terms and the AUP. We may also act on claims of infringement that do not follow this Policy, such as court orders and claims under the laws of other countries.
To the maximum extent permitted by applicable law, we are not liable to you or any other person for removing or disabling access to material, or a Server or IP address, in good faith in response to a notice or to facts or circumstances from which infringing activity appears, whether or not the material is ultimately found to infringe, or for restoring material under section 5. This does not limit liability that cannot be limited or excluded by law, or any right an EU/UK Consumer has under the Terms or mandatory law.
10. Changes to this Policy
For customers, changes to this Policy follow section 18 of the Terms, as for the AUP. For anyone else, the version in force when you send a notice or counter-notice applies to it. If this Policy conflicts with the Terms, the order of precedence in section 1.4 of the Terms applies.
