Acceptable Use & Fair Usage Policy

This policy outlines permitted and prohibited uses of the cloud infrastructure provided by Arct Technology LLC ("Arct Cloud") to protect the integrity of our network. This policy is incorporated into and forms part of our Terms of Service.
By using the Services, you agree to comply with this policy. We reserve the right to suspend or terminate access for any user who violates it.
1. Fair Usage & DDoS Mitigation (Null-Routing)
Our unmetered DDoS protection is designed to deflect malicious traffic from reaching your servers without affecting uptime. However, to protect our shared infrastructure:
- If a DDoS attack against your assigned IP exceeds the capacity of our scrubbing centers, or puts our broader network and other customers at risk, we will immediately null-route the affected IP.
- Null-routing means the IP will temporarily be placed on a route that leads nowhere, making your server inaccessible until the attack subsides (typically 2 to 24 hours, depending on attack severity).
- Once the attack decreases to a manageable size, the IP will be restored to our routing table.
2. Prohibited Activities
You may not use our Services to engage in, facilitate, or host:
- Illegal Activity — Any violation of local, state, federal, or international laws.
- CSAM — Child sexual abuse material. Detection will result in immediate termination and reporting to authorities.
- Malicious Software — Malware, ransomware, phishing kits, or command-and-control (C2) operations.
- IP Infringement — Pirated software, unlicensed media, or illegal torrent trackers.
3. Network & Resource Abuse
- Scanning & Spoofing — Unauthorized port scanning, network probing, or IP spoofing.
- Resource Exhaustion — Running continuous processes (e.g., unauthorized cryptocurrency mining) that severely degrade shared hardware performance.
- IP Blacklisting — If your actions result in our IP space being blacklisted (e.g., Spamhaus), you will be held liable for remediation fees and your service will be terminated.
4. Email & Anti-Spam (Zero Tolerance)
Sending unsolicited bulk email (SPAM) is strictly prohibited. If you operate mail services, you must comply with the CAN-SPAM Act, utilize proper authentication (SPF, DKIM, DMARC), and maintain a clean IP reputation.
5. DMCA & Abuse Reporting
We comply with valid Digital Millennium Copyright Act (DMCA) notices. Upon receiving a valid DMCA takedown notice, we will expeditiously disable access to or remove the allegedly infringing content. Customers may file a counter-notification if they believe the claim is invalid.

6. Enforcement
Upon receiving credible abuse reports or automated network alerts, we reserve the right to warn, suspend, or terminate your Services. For severe violations (e.g., CSAM, outbound DDoS), termination will be immediate and without refund.
